The VA's guarantee makes it a party to the economics, so VA approval can be part of the deal under VA rules.

The process generally involves the borrower's hardship and cooperation and a sale at a reasonable price. The servicer may have delegated authority to approve a compromise sale when VA requirements are satisfied. Certain situations may require additional VA review or approval. VA Borrower Participation Is Important

VA loans include additional VA-specific servicing and guaranty requirements, and the Veteran should remain actively involved with the servicer and contact VA when VA-specific guidance or assistance is needed.

A VA-guaranteed short sale, commonly referred to as a compromise sale, has VA-specific servicing requirements. The mortgage servicer generally handles the loss-mitigation process and works under VA requirements.

The Veteran may also communicate directly with VA or a VA loan technician regarding the VA Home Loan benefit, entitlement, loss-mitigation options, questions about the compromise-sale process, and concerns about servicing of the VA loan.

As part of the compromise-sale process, the servicer must communicate with the borrower and confirm the proposed option is acceptable to the parties.

What veterans should understand

Entitlement is on the table

A compromise-sale claim may affect the amount of VA entitlement available for future use. Veterans should confirm the effect on their individual entitlement directly with VA.

Deficiency depends on the VA

Under the VA's current guidance, the VA may approve a compromise that includes a waiver of the deficiency claim, and protections can apply in some circumstances. The written approval is the binding record, and it should be reviewed carefully with counsel.

The file must be complete

VA documentation requirements depend on the borrower's circumstances, delinquency status, and current VA servicing rules. The file still requires the information and transaction documentation necessary for the servicer to evaluate the compromise sale under VA requirements. VA files reward the same discipline as FHA files.

What agents should know

For listing and buyer agents, a VA short sale means VA-specific servicing and guaranty requirements on top of the normal file: the veteran's purchase, the extension of credit, the entitlement status, and the VA's present-day processing rules. Confirming with the servicer and the VA's current guidance early prevents the file from stalling late in the process.

A note on timing. VA files can move on VA timelines. Start the conversation early, keep the veteran involved, and let entitlement and deficiency questions surface before, not after, the buyer's patience runs out.
